Terms of Service

Welcome to FitCore Gym. By accessing our website, enrolling in a membership, or using any of our services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before proceeding. If you do not agree, please do not use our services.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("member" or "user") and FitCore Gym, located at F44, South City 1, Gurugram, Haryana – 201301. By accessing our facilities or services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Membership Eligibility

To become a member of FitCore Gym, you must:

• Be at least 16 years of age (members under 18 require parental / guardian consent)
• Complete the membership registration form accurately and honestly
• Disclose any pre-existing medical conditions, injuries, or health concerns
• Agree to all rules, regulations, and policies of FitCore Gym
• Pay the applicable membership fees in full

FitCore Gym reserves the right to refuse or terminate membership at its sole discretion.

3. Membership Plans & Fees

All membership fees are payable in advance. Prices are subject to change with 30 days' prior notice to existing members. Annual memberships may be offered at discounted rates.

4. Payment Policy

Accepted payment methods include cash, UPI (PhonePe, Google Pay, Paytm), debit/credit card, and net banking.

• Monthly fees are due on or before the 1st of each month
• A grace period of 5 days applies after which access may be suspended
• A late payment fee of ₹100 applies after the 7th day of a missed payment
• Membership fees are non-transferable to other individuals
• All fees are inclusive of applicable GST

5. Cancellation & Refund Policy

We understand circumstances change. Our cancellation policy is as follows:

• Monthly membership: Cancel anytime with 7 days' written notice before the next billing date. No refund for the current month.
• Annual membership: Cancel within 7 days of purchase for a full refund minus a ₹500 processing fee. After 7 days, a pro-rated refund is available for remaining complete months (minimum 2 months used).
• Freeze option: Memberships may be frozen for medical reasons (with documentation) for up to 3 months per year at no additional charge.
• Special programs / PT packages: Non-refundable once sessions have commenced.

All cancellation requests must be submitted in person at the gym front desk or via WhatsApp to +91 98914 33466.

6. Code of Conduct

To ensure a safe and respectful environment for all members, the following rules apply:

• Always re-rack weights and return equipment to its designated location
• Maintain personal hygiene; bring a towel and wipe down equipment after use
• Wear appropriate sports attire and proper footwear at all times
• Mobile phone calls are not permitted on the gym floor — use the designated area
• Treat all members, trainers, and staff with courtesy and respect
• Bullying, harassment, intimidation, or discriminatory behaviour of any kind will result in immediate termination of membership
• Do not use gym equipment for more than 20 minutes when others are waiting
• Food is not permitted inside the training area (water and protein shakes are allowed)
• Photographing or recording other members without explicit consent is strictly prohibited

7. Health & Safety Waiver

By becoming a member, you acknowledge and agree that:

• Physical exercise involves inherent risks of injury and you voluntarily assume those risks
• You have consulted or will consult a medical professional if you have any health concerns before commencing exercise
• You will not exercise beyond your physical limitations and will inform our trainers of any discomfort
• FitCore Gym, its owners, employees, and agents shall not be liable for any injury, illness, or loss arising from use of our facilities, except in cases of gross negligence by our staff

Members with any pre-existing cardiovascular, musculoskeletal, or chronic conditions must obtain medical clearance and inform our team before starting any program.

8. Facility Rules

• The gym operates from 5:00 AM – 11:00 PM (Monday–Saturday) and 6:00 AM – 9:00 PM (Sunday)
• Operating hours may vary on public holidays — check our website or contact us in advance
• Access is restricted to registered members only; guests must pay a day-pass fee
• Members must carry their membership ID / access card at all times
• Lost cards incur a replacement charge of ₹200
• Lockers are available on a first-come basis; do not leave valuables overnight
• FitCore Gym is not responsible for lost or stolen personal property

9. Personal Training Services

Personal training (PT) sessions are provided by certified trainers as part of Pro/Elite plans or as standalone packages. By engaging a PT session:

• Sessions must be cancelled at least 12 hours in advance to avoid forfeiture
• Sessions forfeited due to no-show or late cancellation will be deducted from your package
• Trainers reserve the right to modify exercises for your safety
• Do not attempt exercises prescribed by trainers without supervision if you are a beginner

10. Intellectual Property

All content on this website — including text, graphics, logos, images, videos, training plans, and workout programs — is the intellectual property of FitCore Gym and is protected under applicable copyright laws. You may not reproduce, distribute, or create derivative works from any content without prior written consent from FitCore Gym.

11. Website Use

This website is provided for informational purposes and general use. You agree not to:

• Use the website for any unlawful purpose
• Attempt to gain unauthorized access to any part of the website or its infrastructure
• Transmit any harmful, offensive, or spam content through any form on this website
• Misrepresent your identity when contacting us

12. Limitation of Liability

To the maximum extent permitted by law, FitCore Gym shall not be liable for: any indirect, incidental, special, or consequential damages arising from your use of our services or website; loss of data or profits; or any damages exceeding the total fees paid by you to FitCore Gym in the preceding 3 months.

13. Modifications to Terms

FitCore Gym reserves the right to update or modify these Terms at any time. Material changes will be communicated to members via email or website notice at least 14 days before taking effect. Continued use of our services after the effective date constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana.
